Website Terms and Conditions

These Terms and Conditions (Terms) explain how Ottoman Beds Ltd (“we” “our” or “Ottoman Beds”) provides and governs access to this website and your use of our services. 

Prior to using this website, please read through these Terms thoroughly.

Using our website, you signify your acceptance of the Ottoman Beds Terms and agree to adhere to them. If you do not agree with these, you must stop using our website immediately.

Ottoman Beds may revise these Terms at any time without notice. Therefore, please check them regularly for the latest changes.

Furthermore, by your continued use of our website, you will be deemed to have agreed to any changes Ottoman Beds has made to these Terms.

Order Amendments

Once the order is placed with us you will have 48 hours to contact us to make any changes to your order. This includes making any changes to the colour/fabric choice or size of the purchased product. Once the product has begun production, we are unable to make any further changes to your order.

Delivery

The delivery estimates quoted on this site are not guaranteed but can be used as reasonable expectation on when you should receive your order. We will do our utmost to meet our quoted timescales. Please note that delivery estimates differ according to product range and delivery location.

If you are unable, for whatever reason, to take delivery of your goods on the confirmed delivery date we will strive to find a suitable date as soon as possible. Our FREE DELIVERY or contribution towards your delivery will only be applicable for the first attempt. Any further deliveries will require a full payment of the delivery prior to the dispatch. Please contact us prior to your purchase for the pricing as each area is charged differently.

If we accidentally damage goods in the course of delivery, then our liability for that damage is limited to the repair, refund or replacement of the goods or the value thereof.

Time of delivery is not of the essence in these Terms and Conditions of Trading. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of OTTOMAN BEDS LTD or delay due to any reasonable rescheduling of delivery.

Our dedicated delivery team strive to deliver all our furniture to the room of your choice. However before you buy, please check that your chosen furniture will fit through hallways and doorways into your home and into the desired room. It is your responsibility to ensure that any furniture ordered will fit into your property and the room of your choice. We cannot be held responsible for any items that will not fit into your property. 

If you need help with this please get in touch.

If for any reason the furniture cannot be delivered into your property due to size restrictions we will deliver the furniture for you into outbuildings/garage at your request.

We will not be held liable for any damage caused whilst trying to get furniture into your property if there are access issues.

IMPORTANT: Please note that if a delivery time is booked in and there is nobody to meet the driver, we will make a charge for redelivery.

Product Specifications

We have a policy of continuous product development and reserve the right to amend the specification of products without prior notice in relation to future sales.

Our furniture is handmade to order, so it will not have the even and consistent finish and appearance found in machine goods. There will be minor variations in colour and appearance between goods provided and images on our website.

You acknowledge that such characteristics and variations are not go be regarded as defects for the purpose of assessing whether or not the goods are of satisfactory quality.

We will endeavour to match the colour and texture of the fabric of your bed to the samples chosen as accurately as possible, but variations in both the colour and texture may occur from batch to batch.

Measurements

The measurements of all furniture and furnishings made by us will be as accurate as possible, but are nevertheless approximate. So please ensure you have space for a small variance prior to making the purchase as everything is made to order.

Returns and Refunds

All our furniture is made especially for you: it is not held in stock. Products that are made especially for you may not be cancelled by you, either before or after delivery. All our furniture with the exception of clearance items are made to your exact specifications and therefore cannot be cancelled once we have accepted your order. These orders fall outside the Distance selling Regulations (2000) which states that personalised goods or goods made to a consumer’s specification are exempt.

All sale items are non returnable/refundable and you will be charged the delivery and collection costs for any non faulty return along with an admin charge at the managements discretion.

Any cancellations made before your furniture has been manufactured or delivered will carry a minimum £49 admin fee.

Guarantees

The provisions of this clause apply in addition to your statutory consumer rights in relation to faulty or misdescribed goods. These rights are not affected by the guarantee. All furniture carries a 12 month guarantee against faulty workmanship and/or faulty materials. Guarantees may not be transferred.

These guarantees do not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage (including rusting and corrosion) due to unreasonable exposure to water or weather; loss or damage due to fire, smoke, explosion, lightning, sunlight, infestation by animals or boring insects, or theft, or accidental damage or loss caused by a third party.

Claims Under Guarantee

In the event of a claim under guarantee occurring, please contact Ottoman Beds LTD.

We will endeavour to repair the defective goods free of charge. If a repair is not possible you will be offered a replacement and only if a suitable replacement is not available will you be offered a refund.

We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods, over and above the value of the goods themselves. This does not affect your statutory rights.

Our guarantees are limited to goods sold and retained in the United Kingdom, and used solely for private and domestic purposes.

Acceptable use

You agree that you may only use the Ottoman Beds website for:

• your explicit personal, non-commercial use that must be reasonable at all times and not offensive); or

• purposes related to the use of our services; or

• gaining information on or confirming the suitability and availability of our products or services; or

• providing and sharing your remarks and observations on our products or

Limitations

You agree that you shall not:

• use, reproduce, reuse or exploit any material on this website for any commercial purpose or any unlawful purposes; or

• use the Ottoman Beds website or services in a way that causes or may cause violation of the rights of any other party or violate any laws, regulations, or codes of conduct of any applicable authority; or

• use our website in any way that hampers performance, or interferes with other users’ use of our website in any manner; or

• attempt to gain or gain any unauthorised access to our website; or

• obscure, remove or alter any copyright, trademark, or other patented notices connected with our website; or

• provide or use any deceptive identity or misleading information.

User-generated content

All content you submit to Ottoman Beds by any means, whether by way of reviews, comments, or ratings and publicised on our website you own and grant Ottoman Beds non-exclusive, perpetual, worldwide, royalty-free rights and license to use, distribute, reproduce, modify and display such content in all forms of media.

All content you submit shall be your own and shall not in any manner be an infringement on any other parties’ rights. You must not submit any, abusive, defamatory, unlawful pornographic, or obscene content or any material that violates any applicable laws.

Ottoman Beds will not be responsible or liable for any user-generated content including, without limitation, any errors or omissions, or inaccuracies, nor for any damage or loss sustained by the use of any such content submitted and made available to Ottoman Beds.

Furthermore, Ottoman Beds reserves the absolute right to remove any content you submit from this website at any time, at our discretion, without notice.

Viruses and malicious technologies

Ottoman Beds is not liable for any loss or damage caused by any virus or other harmful or malicious technology that may infect your computer equipment or data resulting from your use of our website.  

We recommend using appropriate anti-virus software and other technical security measures to protect your computer equipment and data from viruses and other malicious software.

Website availability and accuracy

While we try our best to ensure that you can use this website, Ottoman Beds shall not be liable for any interruption or unavailability of this website, including any technical malfunction, misconfiguration, error, failure, or delay in any electronic user communication or transmission.

Ottoman Beds accept no liability or responsibility for your inability to receive any of our content due to your computer equipment, computer network, or network providers configuration.

Ottoman Beds makes every effort to ensure that the content on this website is correct, up-to-date, and error-free, but to the extent permitted by law, Ottoman Beds does not guarantee the accuracy and completeness of the information provided on this website.

Ottoman Beds reserves the right to change, suspend or terminate all or any part of this website, at any time, without notice.

Any reliance that you may place on the content contained on the Ottoman Beds website is solely at your own risk.

All products and services presented for purchase or use on the website are subject to availability. They may alter or discontinue at any time without notice.

Ottoman Beds provides no warranty that the description of the products or services is free from errors or inaccuracies.

Eligibility

To be eligible to purchase our products, you must be 18 years of age or older and be able to enter into a legally binding contract.

Placing and accepting orders 

Placing an order will amount to making an offer to purchase products or services from Ottoman Beds.

Upon an order placed and your payment card debited at the point of checkout, you will be sent an email as confirmation. A contract will be formed between you and Ottoman Beds upon the order being accepted.

Certain circumstances may arise that could be outside our control which may result in the refusal of sale of our products or services. However, Ottoman Beds reserves the right, at our discretion, to refuse sale for any reason.

Price and payment

Prices presented on this website, including any related charges and appliable taxes (unless otherwise detailed), are those that are stated at the time you place an order.

If an error in the price of a product or service has been identified, we will advise you as soon as possible, cancel the original order, and provide a refund where we have received payment from you. We will correct the pricing error and allow you to reorder at the correct price. Your cancelled order will be refunded to you within 14 days upon confirmation of cancellation.

 Payment for all products or services can be made using a credit or debit card using Shopify and Klarna payment services.

Use of personal information

Our Privacy Policy, available on this website, explains how Ottoman Beds collects and processes your information. By agreeing to these Terms, you signify your acceptance of the terms of our privacy policy.

Links to other websites    

From time to time, Ottoman Beds may provide hyperlinks on this website to appropriately selected third-party websites for your convenience. However, this does not mean Ottoman Beds endorses these websites or accepts any responsibility, or warrants the content of these websites.

Intellectual property rights

All intellectual property rights, trademarks, or copyrights on this website, and its content, including without limitation, the text, design, images, graphics, logos, photographs, artwork, and all software connected with this website, are the property of Ottoman Beds or our affiliates including our licensors. All such rights are reserved.

You agree that accessing this website, and its content, is only for your personal, non-commercial-related use.

You are forbidden from downloading, copying, reproducing, transmitting, storing, selling, or distributing any content without the prior written consent of Ottoman Beds except for the following:

• you can view and display the content on the Ottoman Beds website;

• you can print or download excerpts or entire pages from this website for reference, but only if you have not deleted the copyright notice from the printouts and downloads.

You shall not modify the paper or electronic copies of any material you have downloaded or printed off to any extent.

If you print off, copy or download any portion of this website in breach of these Terms, your entitlement to use the Ottoman Beds website will end instantly. You shall, at our decision, return to Ottoman Beds or destroy any copies of the materials you have produced.

Just as Ottoman Beds requires users to respect our copyright, we respect the copyrights of other parties. If you believe Ottoman Beds has reproduced your copyrighted work on our website, without authorisation, in a manner that is a copyright infringement, please get in contact with us.

Limitation of liabilities

To the full extent permitted by law, Ottoman Beds and any of its affiliates (if any) will not be liable for any damages, including without limitation any, direct, indirect, or compensatory loss, loss of revenue, profit, income, or data which you may suffer arising out of or in connection with your use of our website and services.

These Terms do not decrease your rights under applicable laws or other statutory rights, nor do they deny or limit the liability of Ottoman Beds to you for personal injury or death caused by our negligence or fraudulent misrepresentation, or any other liability, which may not be excluded by applicable law.

Indemnification

You agree to the maximum extent permitted by law to indemnify Ottoman Beds and any of its affiliates (if any) from and against all liabilities, demands, losses, costs, damages, and expenses (including reasonable legal costs) incurred by Ottoman Beds or any of its affiliates resulting from any breach of these Terms, or our Privacy Policy or applicable laws or regulations or claims resulting from your fraudulent, neglectful, or illegal activities that infringe any other parties’ rights.

Severability

If any element of these Terms is determined to be invalid or unenforceable under any applicable law, the invalid or unenforceable provision will not make these Terms unenforceable or invalid, and that invalid or unenforceable provision will be removed without affecting the remaining provisions.

Entire agreement

These Terms represent the whole agreement and supersede all prior agreements and understandings between Ottoman Beds and you concerning your use of our website and services.

Termination

If we unilaterally believe that you have violated these Terms, Ottoman Beds reserves the absolute right to terminate your continued use of our website and services.

Jurisdiction and applicable law

These Terms will be governed by and interpreted following English law. Any disputes related to these Terms will be resolved by the exclusive jurisdiction of the courts of England and Wales.
